No Other Way to Describe It

Bad stuff dredged up from the old company again. Two different instances, actually. Sigh.
The state is going after employees for...well, we're not sure yet whether they just want information or whether they're going to try get money from us, too. The Receiver had said, back in June, that they had the option, if they couldn't get money from the old owner, to make the employees pay the taxes even though they've already been deducted from our checks.
I called today to talk to them, on the behalf of the employees. Had to leave a message and they never called me back.
Then, the Trustee is having trouble with employee claims (obviously from people who didn't come back to work) and wants to talk to me to get information.
Our phones at work were out of service (in a large section of LA County) for most of the day, so they called the other plant to ask how to get in touch with me. It made the plant manager angry, so he called (from the other plant) and got all pissy and told me not to answer questions from the Trustee on company time and not to do any work for them, etc., etc.
Sigh. I thought it was all over.
Then, they hired a new guy, who was really demeaning and called me "dear" today. He's supposed to know EVERYTHING and has been getting all his information from ME and then passing it along and looking good.
Double sigh.
I'm going to write. Then sleep.

Which doesn't mean some idiot won't try it -- but once it gets into the news, someone a bit less idiotic will explain that it was all a mistake -- computer error, or something. (Be prepared to inform the news media, if necessary.)

I really hope things start working out at this company, and that all this hassle is off of your back.
And I think you should start calling Demeaning New Guy, "ducks". One "duckie" for every "dear" should do it.

Date: 2005-10-19 03:53 am (UTC)Unfortunately, you can't get around these taxes, even if your employer doesn't pay them. However, if it was withheld from your check, I believe your responsibility DOES end there as long as you show proof. I could be wrong on this as I've never had to contest it with the state, but the fault should lie on the employer and the employer ID number. If the new guys are still operating under that OLD ID #, they are obligated to pay it. If they are trying to withhold it from your check I would call the IRS and ask about the situation anonymously.
Honestly, while I don't claim to be an expert, I've been doing payroll for 6 years now (albeit not in California) and I've never had this situation crop up. If the employer just DIDNT withhold it because they're a jackass and are trying to cut corners, that's different. The state will see you made X amount of dollars so you should have had Y withheld from your check and sent off. But if they DID withhold it and just didn't remit it...they shouldn't be able to come after you. You did your portion.
